This blog addresses key concerns about the Independent Expert Panel definition of ecocide, such as the fact that it only considers unlawful and or wanton acts to fall under the definition of the proposed crime. The authors state that most environmental destruction does not fall under the illegal umbrella and that the use of the word wanton assumes that there are conditions in which it is permissible to cause environmental damage. It argues that such assumption fails to recognize the gravity of the crime of ecocide which should have a similar no derogation standard as human rights crimes such as torture.
