Gholamali Ghasemi & Sharareh Abtahi, Ecocide in Armed Conflicts with a Focus on the Situation in Israel and Palestine: Challenges for the International Criminal Court, International Law Review, Vol. 41(76), pp. 177-182 (2025)

This article (original extended version in Persian, pp. 103-122) explores the concept of ecocide within the context of the Gaza conflict, analyzing whether the widespread and long-term environmental destruction resulting from Israeli military operations constitutes a prosecutable international crime. The are numerous challenges to prosecuting ecocide in Gaza, especially given Israel’s non-party status to the ICC and the resulting jurisdictional and enforcement limitations. Drawing on international legal sources, academic commentary, and the 2024 ICC arrest warrants for Israeli and Hamas leaders, the study highlights the legal and institutional gaps in addressing environmental crimes and reflects on the prospects of integrating ecocide into international criminal law. Ultimately, it calls for stronger international mechanisms to ensure accountability for environmental destruction in armed conflict.
